Zur Zeit herrscht immer noch das Notrecht in der Schweiz. Dieses ist limitiert auf 6 Monate, es sei denn man überführt das Notrecht in ein dringliches Bundesgesetz. [1]

Also wenn das nicht ein Trojanisches Pferd für unsere Bundesverfassung ist?

Alle Macht beim Bundesrat -- so wurde die Schweiz während der Weltkriege und auch Jahre darüber hinaus regiert. Volk und Parlament hatten kaum etwas zu sagen. Erst eine Volksinitiative erzwang vor 70 Jahren, im September 1949, die Rückkehr zur Demokratie.

Etliche Beispiele zeigen, dass der Bundesrat seine Kompetenzen missbrauchte: So führte er etwa in Eigenregie die Todesstrafe wieder ein. Und gewisse Entscheide prägten den Schweizer Staat nachhaltig, beispielsweise bereitete der Bundesrat mittels Notrecht den Weg für die Sozialversicherungen.

Wie hat das Vollmachtenregime die Schweiz verändert? Wie autoritär regierte der Bundesrat dazumals? Und könnte die Regierung heute erneut eine solche Machtfülle erhalten? Diesen Fragen gehen wir nach, zusammen mit Andreas Kley, Professor für öffentliches Recht und Verfassungsgeschichte an der Universität Zürich.
