Wer aber für sich oder seine Familie und enge Freunde eine kopiergeschützte CD brennt, soll dafür nicht belangt werden können. Auch soll der Download kopiergeschützter Musik und Videos aus Tauschbörsen nicht verboten werden. Konsumenten sollen nämlich nicht entscheiden müssen, ob ein Angebot legal oder illegal ist. Strafbar bleibt aber der Upload von Dateien.Nun wird sich der Nationalrat mit der Vorlage befassen müssen. Bleibt es bei den derzeitig vorgesehenen Regelungen, erhält die Schweiz ein deutlich liberaleres und konsumentenfreundlicheres Urheberrecht als es zum Beispiel Deutschland oder die USA haben.
